Terms and Conditions of Sale

By touching the start screen on a Fotomatica Studio Photo Booths and presenting your payment card or device (Apple Pay or Google Pay), you initiate a session and accept the following terms and conditions of sale.

1. Session Process

Once payment is accepted, the Photo Booth will take between one and four photos, depending on the format selected.
Printed images will be available at the print door just seconds after capture.
Depending on the format chosen, digital images will be securely transmitted to our servers. At the end of the session, you may enter your email address to receive your digital images and GIFs.

2. Service Guarantee

We strive to ensure that all our Photo Booths are in perfect working condition, fully stocked with paper and ink.
However, due to circumstances beyond our control, technical glitches may occasionally prevent you from receiving your printouts or digital files.
In the event of a confirmed failure, the customer is entitled to a refund. Claims must be submitted within 7 business days following the event or session.

3. Image Use and Copyright

Fotomatica Studio will not share or use images, photos, or GIFs captured at private events without the prior written consent of the client or the individual who owns the image rights.
For promotional or free-to-use events, images may be used for advertising purposes only if the customer provides express consent on the Photo Booth screen before starting the session.

4. Protection of Minors

Use of our Photo Booths by children under 13 years of age requires direct supervision by an adult or the consent of a parent/legal guardian.
Fotomatica Studio complies with child protection regulations (COPPA in the United States) and reserves the right to delete any data associated with minors if collected without valid consent.

5. Data & Privacy

Uncollected Prints:

Fotomatica LLC is not responsible for printed photos that are not collected by the customer immediately after completing their Photo Booth session. All photos are automatically printed as part of the service and made available in the output tray. Once placed in the tray, the custody and responsibility of these prints rests solely with the customer.

In the case of Photo Booths located in public or private venues (bars, restaurants, shopping centers, hotels, etc.), Fotomatica LLC does not control or supervise how third parties may handle or display printed photos that have been abandoned or left in the Photo Booth area.

Data we collect:

Personal information (name, email address, etc.)
Digital images from the Photo Booth session
Last four digits of the payment card and card type/device (via Nayax POS)

How we collect data:

By using the Photo Booth and making payment
By entering your email during the session or through online forms
By contacting us directly via email, WhatsApp, or phone
By browsing our website (cookies)

How we use your data:

To email you your digital images and GIFs
To process refunds and provide customer support
To share, in some cases, your email and consent status with partnered venues. After secure transfer, personal data is deleted from our database.
For promotional purposes in free-to-use events, only with prior on-screen consent.

How we store your data:

Data is securely stored on servers with strict protection measures.
Personal data is retained only as long as necessary and deleted when no longer required.

Your rights:

Right to access, rectify, erase, restrict processing, object to processing, and request data portability.
We will respond to requests within 30 calendar days.

6. Cookies & Website Use

Our website uses cookies solely to improve user experience and optimize our services.
We do not sell or share personal information with third parties without your express consent.
You may disable cookies in your browser, though some website features may not function properly as a result.

7. Legal Jurisdiction

These Terms & Conditions are governed by the laws of the Commonwealth of Puerto Rico and the federal laws of the United States of America.

Any legal disputes must be resolved in the competent courts of San Juan, Puerto Rico.
